"The proposed Directive on the harmonisation of copyright in the Information Society adopts an extremely broad definition of the reproduction right. Such a notion runs the risk of causing confusion between the ways in which protected works and related subject-matter are exploited. In particular, it would remove all content from the regulation of the right of communication to the public in every case where such communication takes place on the basis of a reproduction. Since there is always just one act of intangible exploitation, as defined by the law, it is essential that any merely technical processes which are necessary for the professional use of a right, granted by contract or by the law, should be presumed to be included in that right".
