Decision 344 was adopted in Venezuela in August 1992. This means that the party whose mark is being cancelled (due to non-use) has to prove use of the mark during the three years prior to the filing of the cancellation action. This differs from the Venezuelan Industrial Property Law of 1955 under which the burden of proof was on the part requesting the cancellation.
