Note
"English musical groups and their advisors must be proactive in the creation and documentation of the appropriate organisational vehicle or suffer the consequences of the default provisions of The Partnership Act 1890. The recent case of Joyce v. Morrisey (The Smiths case) illustrates the potential for inharmonious results when a band's early oral agreements resurface in a later dispute between members. Artists are often amazed that because they have not formed a limited company or created a partnership agreement, their actions are governed by a statute over 100 years old."
