"The Trade Barrier Regulation (TBR) provides a mechanism for European Union Member States and businesses to challenge discriminatory non-E.U. laws via the European Commission and, ultimately, the World Trade Organization. This article examines how the TBR can be employed by E.U. based organisations to challenge discriminatory intellectual property laws in third countries and the extent to which such challenges can achieve a level global playing field for the protection of intellectual property rights."
