Jacobs A.G.'s Opinion in Upjohn v. Paranova recommends that rebranding of a parallel imported product (at least a pharmaceutical product) should be permitted where it is necessary to overcome an obstacle to market access. If adopted, it would diverge from previous ECJ authority and leave open significant issues which are likely to lead to differences in approach by national courts. Further, adoption of this broad approach raises issues of TRIPs compliance.
