The law on fair dealing with another's copyright-protected works for the purpose of reporting "current events" is clear and simple: private rights are respected, but allowances are made for non-commercial erosions of those rights for the sake of the public interest in being kept informed. Strangely, while the law is so clear, it's only the facts of actual disputes that give rise to problems. Two recent cases, involving Mandy Allwood and Marks & Spencer, illustrate contrasting applications of the fair dealing rule.
