Note
The possibility for the owner of a Community trade mark to claim the seniority of earlier national rights for the same mark was intended to be one of the pillars of the system. In this article the authors explain the procedure, and how changes in practice by the OHIM [Office for Harmonisation in the Internal Market (Trade Marks and Designs)], and decisions by the Boards of Appeal have blunted the alleged advantages of a seniority claim.
