Note
The Digital Millennium Copyright Act (DMCA), which prohibits tampering with technological protection for copyrighted works, will substantially restrict the scope of fair use of digital works. In order for fair use to survive as anything more than an assortment of narrow, ad hoc exceptions, the U.S. legal system will need to address the developing conflict between traditional copyright principles, which require a balance between authors' rights and the public interest, and unlimited private ordering via licence. The Digital Millennium Copyright Act is included in an appendix.
