- At present the United States is the only country in the world to have a "first to invent" patent system where rights stem from the date an invention is conceived; - The introduction of a grace period such as presently proposed brings with it increased uncertainty for those attempting to evaluate the validity of patents which belong to competitors; - The short answer which the Commission will get in the hearing is likely to be that the grace period on offer would not have been acceptable as a quid pro quo for a first to file system in the USA;.
