Intellectual property : litigation, legislation, and education : a study of the Canadian intellectual property and litigation system / Gordon F. Henderson.
In a survey conducted on behalf of the Department of Consumer and Corporate Affairs of the Government of Canada, many owners and users of intellectual property rights in Canada had expressed dissatisfaction with the litigation system. This study was commissioned in order to identify what could be done to improve the system. This document discusses the overall litigation system as it now stands; why litigation is so expensive; expertise and education; particular aspects of litigation; arbitration; strategic aspects of litigation for trade and industry; competition, access to the courts, and criminal law; a new tribunal; and legislative renewal. It includes a summary of conclusions and recommendations.
