Passing-off defends business goodwill against misrepresentation. In recent years passing-off has had a flood of new questions to answer: how does one deal with the plaintiff whose business is carried on abroad, or has been advertised but not yet started? Does it matter that the plaintiff is engaged in licensing, franchising, or character merchandising? When is the defendant liable for exports or for unauthorised imports?
