"Under what circumstances are internet service providers liable for unlawful material posted by third parties on their facilities? This article examines liability solutions offered by the E-commerce Proposal. In contrasting the European solutions to their U.S. counterparts embodied in the DMCA, the author focuses on the unfortunate lack of regulation of both notice and take-down procedures and the potential liability deriving from using linking techniques."
