"Procedural law that applies to oral proceedings is reviewed with reference to the effective handling of unexpected events. These can include newly submitted documents, late-filed experimental reports, surprise witnesses and last minute claim amendments. Appropriate response is considered based on the underlying principles of ex officio examination by the EPO, avoidance of procedural abuse, and the need to give parties an opportunity to comment on objections and submissions made against them".
