Summary
"The notion of the exhaustion of intellectual property rights is an important one for the free movement of goods within the European Union. According to Council Directive 92/100, whereas exhaustion follows sale or distribution of copyright goods, for rental or lending purposes rights assignments may better be dealt with on an individual contractual basis. In Portugal, a net importer of copyright goods, not only are these rights not exhausted in the latter case but they are favoured with equal stamina in the former. The article concludes with the anticipation of a challenge to this perplexing inconsistency in the Portugese courts."
