"In Novartis, the EPO has yet again tackled the exclusion of plant varieties from European biotechnology patents. This article presents an alternative approach to understanding the subject matter of patents in general and plant appropriation in particular. It sets out a range of methods to interpret Article 53 of the EPC. Finally, some of the biological and legal factors relevant to the scope of property rights for living organisms are explored."
